  • INTRODUCTION

MEDIAGURU B.V., trading under the commercial name 'MediaGuru' with registered office at 2550 Kontich, Groeningenlei 92 - registered with the Crossroads Bank for Enterprises under number 0765.203.306, (hereinafter referred to as "MediaGuru" or "We") as Processing Controller will only collect, store, process and transfer your Personal Data (as listed below) (hereinafter referred to as "Processing") in accordance with applicable Belgian and European privacy legislation including, but not limited to, Regulation (EU) 2016/676 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), (hereinafter referred to as "AVG") and the Belgian law of July 30, 2018 regarding the processing of personal data. 

On the basis of this privacy and data protection policy (hereinafter referred to as "Policy") describe the way we process data relating to you or allowing us to identify you directly or indirectly (hereinafter referred to as "Personal data") in connection with the services MediaGuru provides to present and connect job candidates with potential employers and the agreements signed (to be signed) with MediaGuru in connection with the provision of these services (hereinafter referred to as "Services"). More specifically, we explain how and why we collect your Personal Data, what we do with it, with whom we share it, how we protect it, how long we keep it, and inform you of your rights. 

When you accept the provisions of this Policy or use the Services and submit your data to MediaGuru, it means that you consent to the way we process your Personal Data, contained in this Policy.

  • WHEN DO WE COLLECT YOUR PERSONAL DATA? 

We collect your Personal Data when you: 

  • Submit your personal and contact information to us through a form or by any other means. 
  • You contact us for information regarding the services we provide. 



  • WHAT PERSONAL DATA DO WE COLLECT? 

We collect the following (categories of) Personal Data in relation to the Services:

Personal information you may provide to us: 

  • Identification and contact information: first name, last name, e-mail address, phone number;
  • Location: your mailing address, home address, professional address;
  • Payment information: bank account number, ...; 
  • Cookies and similar technologies; 
  • Log files when using our services; 
  • Metadata; 
  • Analytical data;
  • Work experience and information you communicate as part of an introductory interview; 

Sensitive Personal Data (hereafter "Sensitive Personal Data") that you provide to us (health data related to your ability to work).

  • Legal grounds:
  • When the processing necessary is for the performance of a contract to which you are a party or to take action at your request to provide the Services.
  • When processing necessary is for the protection of our legitimate interest except when our interests must give way to your fundamental rights and freedoms: 
    • To provide you with information regarding our similar products and services and to respond to your questions/complaints;
    • To compile anonymized statistics;
    • Etc. 
  • Occasionally, we may ask you for your specific permission request to process certain Personal Data and we will only process your Personal Data in this way if you give us your consent to do so. Please note that you always have the right to withdraw your consent at any time by sending an email to info@mediaguru.be

  • Where the processing of your Personal Data is necessary to comply with a legal obligation:

    • Providing information to a government or law enforcement agency 
    • By court order 
    • Etc.
  • Purpose of data processing:

We will process your Personal Data only for specific purposes. We will not further process your Personal Data for any purpose other than as described below. 


We will process your Personal Data for the following purposes: 


  • To contact you regarding job opportunities and our services;
  • To present your profile to potential employers and put you in touch with them;
  • For any interactions you have with us regarding our services. This includes, but is not limited to, entering into an agreement with us, administrative purposes to best perform our services, etc. 
  • For any other interactions we may have with you. For example, when you contact us for questions, comments, complaints or other inquiries to respond to your inquiry.
  • To maintain the accuracy and relevance of your Personal Data; 
  • For marketing purposes such as newsletter subscription.
  • Retention time

We keep your Personal Data only as long as necessary and ensure its appropriate protection. How long we keep your Personal Data depends on the purpose for which we use it, as described in this Policy. 


After termination of the Services, we will delete or anonymize your Personal Data no later than after five (5) years.



  • HOW DO WE PROTECT YOUR PERSONAL DATA? 

We have taken a number of technical and organizational security measures to protect your Personal Data from unauthorized or unauthorized access or use and from accidental loss or damage to its integrity. These measures have been taken taking into account our IT infrastructure, the potential impact on your privacy, the associated costs and in accordance with current industry standards and practices. 

Your Personal Data will only be processed by a third party if that third party agrees to comply with technical and organizational data security measures.


  • WITH WHOM DO WE SHARE YOUR PERSONAL DATA? 

Depending on the purpose for which we collect your Personal Data, we may share your Personal Data with another affiliate or subsidiary of MediaGuru.

Furthermore, for the provision of our services, we may share your Personal Data with third parties that are trusted partners in ensuring our operability and continuity of our services, such as social media platforms e.g. Facebook, Linked-in, Instagram, Google or Apple... (see also art. 9) Also, we will communicate your Personal Data to potential employers. An updated list of recipients and/or categories of recipients can be received upon request.

These partners have confirmed to us to respect the AVG (and all other applicable Belgian and European privacy laws) and not to use the data for purposes other than the aforementioned.

Finally, we may disclose your Personal Data to third parties if we are required to do so by law and/or regulation, if we are forced to do so as a result of legal proceedings and/or in the event we deem it necessary to protect our won rights.

  • DO WE TRANSFER YOUR PERSONAL DATA INTERNATIONALLY? 

In order to provide our services, we may transfer your Personal Data to third parties in other countries within the European Economic Area. 

It is possible that your Personal Data may be transferred to a partner of MediaGuru outside the European Economic Area (EEA). Any transfer to a recipient with domicile or registered office in a country without an adequacy decision (link), taken by the European Commission, will be covered by an agreement covering the requirements for the transfer of personal data outside the EEA, such as the standard contractual clauses approved by the European Commission (link).


  • USE OF COOKIES 

We make use of so-called "cookies" on our website. Cookies can be regarded as pieces of data sent by the web server to your browser, which writes this data onto your computer's hard drive. The use of cookies enables us to provide you with faster and more efficient access to our website. You can disable the use of cookies in your browser settings. If you disable the use of cookies, our website will still be accessible, but you may not have access to all of its functionalities.

  • USE OF SOCIAL MEDIA  

If you register with MediaGuru or through an Application or fill-in form on a (social media) account of a third party, such as (but not limited to) Facebook, Instagram, Google or Apple, etc., you accept that the terms of use and privacy policy of the third party in question will apply. We are not liable for the processing of your Personal Data by these third parties. 


  • WHAT ARE YOUR RIGHTS? 

Please note that you have the following rights regarding our processing of your Personal Data: 

  • Right of access and correction: you have access to your Personal Data. Before granting you access, for security reasons we may ask you to prove your identity and provide the necessary information regarding your interactions with us. Where we agree that we need to provide you with access, this will be done free of charge but only for your initial request. If the Personal Information we hold about you is inaccurate, you may ask us to correct any inaccuracies;
  • Right to restriction of processing: you have the right to request a restriction of processing when we do not (or no longer) have the right to use your Personal Data or when you dispute its accuracy;
  • Right to object to processing: if applicable, you have the right to oppose the processing by us of your Personal Data for certain purposes. In particular, you may oppose, free of charge and without any justification, processing for purposes of direct marketing (e.g. emails);
  • Right of removal: you have the right to delete all your Personal Data (except in some cases, for example, to prove a transaction or when required by law); 
  • Right to data portability: under certain conditions, you have the right to receive your Personal Data that you have provided to us in a common, structured, machine-readable format and to transfer your Personal Data to a third party of your choice.
  • Right to withdraw your consent: where your Personal Data is processed on the basis of your consent, you may withdraw this consent at any time, without justification;

You may make a request or exercise these rights by contacting us (see Art. 2 for our contact details), whereupon we will make all reasonable and practicable efforts to comply with your request to the extent that it does not conflict with applicable law and professional standards. However, you should be aware that the Personal Data (and processing) is necessary for the performance of the Services and/or for our legitimate interest. This means that any modification to your original consent may result in the termination of the Services.

We aim to respond to your inquiry within four (4) weeks.

If you do not agree with the way we process your Personal Data, you can always file a complaint via e-mail info@mediaguru.be.

If you are not satisfied with our response/resolution, you have - in any case - the right to file a complaint with the Belgian Data Protection Authority acting as supervisory authority:

  • CHANGES TO OUR POLICY

From time to time, we may supplement, amend, update or modify this Policy. If we change the Policy in a way that affects how your information will be used or the rights you grant to MediaGuru, we will notify you and ask you to review the new Policy. At that time, you may choose to accept the new Policy and continue to use our Services, or you may stop using our Services. We may not notify you of changes that do not affect how your data will be used or the consent you give us. 

We encourage you to review this Policy periodically to stay informed about how we process and protect your Personal Data.
